Citizenship of Ukraine as a Factor That Significantly Affects the State of Ensuring the National Security

Abstract

The article presents the results of the study of the Institute of Ukrainian Citizenship as a factor that significantly affects the state of ensuring national security. The results of the study of the content and form of the constitutional and legal regulation of multiple citizenship in Ukraine are made public, and attention is focused on the existing problems of legislative support for the functioning of the institution of citizenship. The authors draw attention to the existence of a number of problematic issues related to the acquisition and loss of Ukrainian citizenship. It was concluded that in modern social and political conditions, the institution of citizenship has become one of the factors that significantly affects the state of ensuring Ukraine's national security. Citizenship is considered as one of the elements of the mechanism of admission to participation in the management of state affairs and removal from such participation of persons who have committed crimes against the foundations of national security, peace, human security and international legal order, including during the full-scale invasion of the Russian Federation into Ukraine. The theoretical and practical issues of multiple citizenship have been studied. The results of the analysis of individual legislative initiatives on solving problems related to the introduction of multiple citizenship in Ukraine have been made public. The shortcomings of the draft laws introduced for consideration by the Verkhovna Rada of Ukraine, the purpose of which is the legislative regulation of certain issues of polypatrism, are pointed out. Attention is drawn to the fact that national legislation does not establish legal responsibility for a person having multiple citizenships. This results in the permanent spread of polypatrism among the citizens of Ukraine in the conditions of modern economic, social and security challenges. A conclusion was made about the impracticality of implementing multiple citizenship in Ukraine during the full-scale invasion of the Russian Federation and the need for a deep analysis of the risks to national security associated with the implementation of the idea of its legislative consolidation and further enforcement.
